Pune: Two men have been sentenced to 10 years’ rigorous imprisonment by a Pune sessions court for attempting to murder a youth with a sickle in Hadapsar in 2018 after suspecting that he and his friend were harassing a woman relative of one of the accused.Additional Sessions Judge Sagar Ramesh Agrawal found Amol Balasaheb Borkar (36) and Sagar Vijay Kale (30) under IPC Sections 307 (attempt to murder) and 323 (voluntarily causing hurt), while acquitting them of offences under Sections 504, 506 and provisions of the Arms Act on May 7. Public prosecutor Namdeo Taralgatti said that the incident took place on June 25, 2018, in the Kalepadal area of Hadapsar. One of the accused Amol Borkar had developed a suspicion that victim Pratik Sapkal and his friend Sumit Rathod, both in their early 20’s at the time of incident, used to harass his cousin while passing near her house on a motorcycle, leading to an ongoing dispute.The judgment stated that earlier on the day of the incident, the accused allegedly intercepted Sumit near Nirmal Township while carrying sharp weapons. Sumit managed to flee, leaving behind his motorcycle, which was allegedly set on fire by the duo.The court noted that later that night, Pratik was allegedly taken to an isolated ground near the Gliding Centre in Hadapsar, where he was assaulted with a sickle.“The injuries caused skull fractures and brain injuries,” the court observed.Rejecting the plea for leniency, the court said, “I do not find a single mitigating circumstances to take or show leniency… It is well settled legal position as to sentencing policy that sentence should be deterrent and an eye opener as well as condemning feelings of the injured and his family.”The court also imposed a fine of Rs 50,000 on each accused. It also directed that Rs 80,000 from the recovered fine amount be paid to the victim as compensation.
